Assisted reproductive technologies and the free movement of persons

A challenge to French law

French law imposes strict conditions on access to assisted reproductive technologies (ART) treatments: on one hand, only living, heterosexual couples at a reproductive age are allowed to benefit from ART treatment; on the other hand, no compensation is given to gametes donors and, in addition, no surrogacy arrangements are enforceable. By contrast, the practices that are forbidden and in short supply in France are performed openly and inclusively in other countries. Consequently, French law is facing complex issues surrounding cross-border care. However, the legal barriers are slowly being overruled.
